Sen. Steve Oelrich, R-Cross City, had a question about a medical malpractice bill up for discussion right now.
Say he had an X-ray at a hospital that contracts with a radiology groups. Say the scans are misread and have some other problems. Under the proposal, he can’t sue the private contractor? Or the hospital?
Sen. Miguel Diaz de la Portilla, R-Miami, said Oelrich was correct and in fact there was a legal term for it.
“You’re S.O.L,” said Diaz de la Portilla.
Barely suppressed chuckles on the floor. Sen. Alan Hays, R-Umatilla, sponsor of the bill seemed to disagree.
“This is plain English,” he said of his bill. “I don’t know that Spanish.”
