Casey Anthony’s lawyer: George Zimmerman’s a victim of prosecutor's ‘political prostitution’

Cheney Mason, the freewheeling criminal defense attorney who successfully defended tot mom Casey Anthony, is shaking his head over the second-degree murder charge against George Zimmerman in the shooting of Trayvon Martin.

The charge leveled by prosecutor Angela Corey is too severe and reeks of political calculus, Mason said.

“It’s political prostitution,” Mason said. “Now I don’t have all the facts – no one does – but you look at what we know of the case and it looks like the prosecutor bowed to other pressures.

“The fact is there is lots of racial bigotry in this case,” Mason said. “And a lot of it is coming from the side of Trayvon Martin’s family. I can understand why his family is upset. They lost a child. But they weren’t at the crime scene. None of us was.”

Mason said Corey is too zealous of a prosecutor.

"This is a person who wanted to put a 12-year-old boy as an adult for murder. It’s just too much,” Mason said.


To prove Zimmerman was guilty of second-degree murder, Corey will have to show Zimmerman acted with a “depraved mind” when he shot Trayvon.

“The only evidence we have now is what Zimmerman says and what an eyewitness says – that Trayvon was beating him,” Mason said. “Well, if that’s the case, this shouldn’t reach a jury. There’s just no evidence showing he acted with a depraved min. If Zimmerman was being beaten, it’s clearly a homicide. He had a right to carry his weapon. He had a right to confront a person who was walking around in a hoodie in the rain around dark when there had been crimes in the neighborhood.”

One-time federal prosecutor, former U.S. Attorney Kendall Coffey, suggested Corey might not stick with the second-degree murder charge through trial.

"This is an aggressive charge," he said. "And there are times when an aggressive charge gives more incentive for the defendant to seek a plea. The vast majority of cases don't go to trial and end in a plea."

Also, Coffey said, a jury could under some circumstances toss the second-degree murder charge and convict of a lesser charge, such as manslaughter.

But will it get to a jury?

Mason said there will be a hearing under Florida’s Stand Your Ground law – which expands the right to use deadly force --  and the charges could be dropped then by a judge. But, Mason said, “people are using Stand Your Ground to obfuscate the facts of this case. This comes down to the fundamentals of homicide. What’s the evidence? The burden of proof is on the prosecution. It’s not on George Zimmerman. And you can’t blame Stand Your Ground for this tragedy.”

Mr. Mason, you seem to be forgetting these charges can and most likely will be ammended. With Florida's 10-20-Life law; he only has to be convicted of a felony, any felony; to spend the rest of his life in prison.This isn't at all like the Casey Anthony case at all except for the overcharge. You did a very good job in the Anthony case; very good indeed. I was proud of our justice system with the jurys findings that day. Now this is very different indeed; like I said even voluntary manslaughter could net Zimmerman life!!!

I agree with Mr. Mason, charges were brought to pacify a situation due to a large amount of racial bigotry towards George Zimmerman by those who do not have the facts. If Mr. Zimmerman did indeed have a broken nose and cuts on his head it will play heavily in the case for self defense. Just as Trayvon had a right to be where he was so did George Zimmerman. If Trayvon did attack Mr. Zimmerman (breaking his nose, slamming his head on the concrete) then the shooting is justifiable an will never see a 2nd degree murder conviction.

No one should seek the opinion of a man that defended a baby killer. The fact is that none of this would have happened had Zimmerman listened to the dispatcher. I don't believe that anyone is folding to the pressures of outside sources. Trayvonn may have been standing his ground. Trayvonn lived in that neighborhood too when he was with his father. George Zimmerman is a man that thought he had the right to act as a law enforcement official. With his criminal history he should have never been allowed to purchase a gun I'm the state of Florida.

I am confused on how anyone can say that the prosecutor overcharged Zimmerman while at the same time concede the fact that they don't know everything that the prosecutor knows. At the end of the day, there was an unarmed dead kid, who was doing nothing illegal at the time he was murdered. He was walking home for the store for Christ sake. This is NOT about race. It is about justice. Imagine your child walking home from the store and being followed, stalked by a stranger who is carrying a gun and kills him because he LOOKS suspicious. Seriously people.

Y'all seem to forget that a detective on the scene that night didn't buy Zimmerman's story and wanted to arrest him.

I figure the only reason that did not happen was that the local prosecutor's staff told them to hold off on an arrest.

I love the 2nd amendment and the "stand your ground" law is a legitimate extension of the castle doctrine to public settings where citizens have a right to be.

But the law only removes the duty to retreat when truly threatened. It does not grant a license to pursue, which it appears Zimmerman admitted to doing.

What's most troubling about Zimmerman's position is this: if he truly feared for his safety from Martin, a stranger, who was cruising through the neighborhood, then he never should have been walking back to his truck.

After losing track of this supposed dangerous person (Martin), either Zimmerman should have been running to his truck or walking backwards toward it, watching out for this supposedly dangerous perp.

I feel terrible for Zimmerman he is a victim. Because of numerous black public figures standing up and publicly demanding he be charged with murder a large portion of these being uneducated comments, and the pawns who love to believe in trending topics but don't really give a damn about the the facts. Martin was "running" away - on a 70 foot pathway - and couldn't get to his house during a time frame of at least a minute? Was he running on his hands? Scratch that, even then he would have been home with time to spare. Well, that is, if that is where he was actually going at least...

Martin, a 6'3" 150 pound football player was "scared" of a little 5'9" 170 pound guy on his cellphone with the police; but never felt the need to call the police himself (or even hang up his phone), go inside his house, get help from one of the many doors around him or even just leave the scene completely. Instead, he decided to confront the man he was supposedly afraid of after "running" around the microscopic corridor a few times, apparently - or, if one is to believe the prosecution, he must have stood around waiting for the big scarey man to confront him I guess

(which, of course, this "confrontation" happened in basically direct line of view to Zimmermans car; clearly indicating Zimmerman hunted Trayvon down as Martin apparently hid 70 feet from his house, in plain sight, in direct view from the man he was so "scared" of, for at least a minute, in an effort to get away...)

Despite all that, the affidavit shows zero examples of all this alleged malice while still indicating self defense on the part of Zimmerman.

Laughable is tossed around too carelessly, but wow does it ever apply here. Clearly this is a show trial to appease the people screaming bloody murder on the street (and on MSNBC). And when the case is either dismissed or pitifully lost based off the lack of any credible evidence, Corey will still be able to say "we tried" and pray you reelect her because of her so-called effort.

On a side note, at least arresting Zimmerman provides him the protective custody he so desperately needs from all the "tolerant" and "peaceful" Left.

blah blah. Excellent post. Martin was up to something. Its just inexplicable that he didn't simply go to his father's girlfriend's house if thats where he was staying. But I have my doubts about whether he was really staying there. Its very strange that no one even noticed him missing until the next day.

In the affidavit, Corey used a statement from Trayvon's mother that it was her son's voice on the 911 tape. How then to explain the fact that Trayvon's father during a television interview in March said that it WASN'T his son's voice, and Trayvon's older brother said that he couldn't tell if it was Trayvon's voice.

Isn't this cherrypicking by Corey? Smacks of bias on her part- calling the parents "sweet".. This is going to backfire on the prosecutor.

Alan Dershowitz, just about the top lawyer in the country says it is reprehensible and irresponsible for her to have charged Zimmerman with this. My bet is that Dershowitz joins Zimmerman's team.

The right charge is first degree murder. The prosecutor only went for 2nd degree, because of political pressure. The prosecutor undercharged. There was no fight as indicated in the medical examiner's report, and consented by three witnesses.

Blah Blah, thank you so much for bringing some sense to this discussion. I'm certainly not a fan of Cheney Mason, the Casey Anthony trial still burns me up. But everyone who comments on this case should do two things, look at the timeline of events and listen to the COMPLETE 911 call George Zimmerman placed. Those are the hard facts we have access to - just avoid audio from NBC or whichever network chose to dishonestly doctor it. Zimmerman called a nonemergency police number at 7:11 p.m. and was led by the dispatcher into providing the race of the individual he was watching. He exits his vehicle about two minutes into the call, you can hear the door ajar beep. After the dispatcher tells him not to follow Trayvon, Zimmerman clearly stops giving chase and continues talking to the dispatcher for nearly two additional minutes providing his name, address, location, etc. At that point, he had clearly lost sight of Trayvon for almost two minutes. When Zimmerman stopped pursuing Trayvon about halfway through his 911 call, Trayvon would have been approximately 70 yards from his father's girlfriend's house. Running, he should have easily made it to the house before Zimmerman completed his call with the 911 dispatcher, which ended at 7:15 p.m. By 7:16 p.m. 911 calls were coming in about the fight. By 7:17 p.m., a police officer was on site from Zimmerman's original 4 minute call. So basically, in what would amount to less than a minute, Zimmerman would have had to get off the phone with the dispatcher, somehow catch up with Trayvon who had a good two minute head start, start a confrontation, still leaving enough time in that minute for neighbors to hear the screams, call 911 and get through to a dispatcher. Zimmerman must be one fast fellow, if you believe that. I'm not at all saying that young black men are not unfairly targeted on a regular basis, but this is not the case to make that argument with. There are only three reasons people would have such annimosity toward Zimmerman. 1- they truly believe a man who worked with underprivileged kids of all races unfairly targeted this young man and killed him in cold blood because of his race. 2- they don't like the gun laws in Florida, easy solution, don't live there, that's the beauty of states having the right to govern themselves. 3- they honestly believe that, given the timeline of the 911 calls and all of the evidence, George Zimmerman was able to track down Trayvon Martin, who had a nearly two minute head start and only 70 yards to run, in less than a minute and start a confrontation. My heart goes out to Trayvon's family. This is a senseless tragedy that came out of a misunderstanding on the parts of both individuals. But under Florida's law, I don't see how anyone could legitimately say this will get a second degree murder charge or even jail time.

prosecutors did not include the evidence of Zimmerman's head injuries in their affadavit, which is considered falsifying evidence or just plain lying to make it appear you have a legitimate case. No doubt this was an act of self-defense. Martin had no business assaulting a neighborhood watchman who was calling law enforcement for assistance.
