Fort Lauderdale judge hears arguments in Florida voter-purge lawsuit

A federal judge in Fort Lauderdale heard arguments Monday — but likely won’t rule until later this week — in a lawsuit challenging Florida’s contentious noncitizen voter purge.

At the heart of the case is a question of timing: Is it OK for the state to remove voters who are not citizens from the rolls 90 days before an election?

A coalition of liberal voting-rights groups, citing the risk of purging lawful citizen voters, says it’s not. Gov. Rick Scott’s elections department says it is — and last week produced a new list of 198 potentially ineligible voters to be reviewed by independent county elections supervisors.

Federal law generally prohibits purging voters 90 days from Election Day. That prohibition, which lists a few exceptions, is so broadly written that it should apply to noncitizens, argued Marc Goldman, an attorney for the coalition.

“If you do a big government program, the list is going to be inaccurate,” Goldman said. The law, he added, “is intended to bar any systematic purge.”

But Michael Carvin, an attorney for Florida Secretary of State Ken Detzner, whose department created the list of potentially ineligible voters, said the state has discretion when dealing with noncitizens.

He countered that the 90-day prohibition applies to purging once-eligible voters who are no longer eligible — and not to noncitizens who were never supposed to register in the first place.

“If Fidel Castro showed up to vote, we couldn’t remove him from our rolls,” Carvin said, calling the coalition’s argument “absurd.”

You're wrong.

2nd, the Doc Fix has been around almost as long as Medicare. Simply put, the law doesn't match the inflation in the industry it covers. This will continue to be a problem until Congress addresses the factors that run medical costs up at 3 times the rate of inflation. Congress won't do this so every time we turn around, Congress has to put off the limits allowed to be paid to doctors again.........& again......& again. You can't blame the President for what Congress refuses to fix.

3rd, Hospitals are responsible for the care of their patients. The law you're referring to is a penalty for hospitals that have to re-admit patients too soon after release on the theory that they didn't do something right or the patient wouldn't need readmission.

I don't know about your cancer patient but I know of nothing in the PPACA that restricts the treatment you're talking about - and I have read the entire 900 page bill.

5th. Maybe you're comfortable with Romney /Ryan screwing over your kids Medicare and Social Security but I'm not. Just because we 'get a pass' doesn't make it right to penalize my child. I LIKE my children. I am at least ambivalent about your feelings towards yours.

6th, I WILL vote for President Obama because he has us on a road to recovery and if we can get a Congress that knows the word negotiate again, we'll get better faster. This is the first time in history that a Congress refused to help pull the country out of recession just because they don't like the guy in the White House.
BOTH sides have put country before party in the past to get it done. This bunch of clowns in the Republican House should be tried for Treason for willingly putting their country in peril to win the White House.

Governor Scott and his puppets are trying to pull a '2000' all over. The Judge should step in and slap them down.
So far, they've spent 1000s of dollars and, at last count, identified 36 people who MAY have voted illegally. Now, that's BANG for your BUCK.
Ostensibly this was about voter fraud.
Factually, it was about disenfranchising Florida voters so that Florida politicians could make the same brag as that idiot in Pennsylvania.
