Democrats pounce on Scott's Dreamers veto as a 'step backwards' on immigration reform

Florida Democrats have seized on an opening Gov. Rick Scott has given them to make some noise about the governor's rocky relations with the Hispanic community.

The governor on Tuesday vetoed a non-controversial bill passed with near unanimous support by the Republican-controlled House and Senate that would have helped children of illegal immigrants who attend school in Florida obtain temporary driver’s licenses. 

The bill was seen as non-controversial because the Florida Department of Highway Safety had already been pursuing rules to allow documents obtained by children granted legal status under the Deferred Action for Childhood Arrivals program to be accepted as one of the forms of identification used to obtain a temporary drivers license in Florida.

The deferred action program was adopted by President Obama last year to allow children brought to this country illegally to be exempt from deportation. It received widespread praise from Hispanics on both sides of the aisle. 

But Scott justified his decision by noting in his veto message that Congress never approved the policy. 

"Although the Legislature may have been well-intentioned in seeking to expedite the process to obtain a temporary driver's license, it should not have been done by relying on a federal government policy adopted without legal basis," Scott wrote.

In a stream of press releases and at a televised media event in Orlando on Wednesday, Democrats pounced on the governor for going backwards in the progress on immigration reform.

Now dreamers in Florida with no criminal history will have work permits but won’t be able to drive to school or to work – that is nonsense,'' said Rep. José Javier Rodríguez, D-Miami Beach in a statement. "Today our governor showed us that he lacks the courage to confront the most extreme elements in his party that seek to marginalize immigrants, particularly Hispanic immigrants."

Sen. Darren Soto, D-Orlando, who was joined by several other lawmakers at a press conference there, said the legislature passed the bill because "these young Floridians receiving deferred action require a driver’s license to pursue the American Dream" but Scott’s veto "flew in the face of this fundamental belief, and has effectively denied this opportunity for thousands of young Hispanics, Haitians, and other immigrants legally here in our Great State.” 

Howard Simon, executive director of the ACLU of Florida. said the veto "sends a message that he’s willing to play politics with the lives of young people'' and "creates a needless stumbling block for young people who have grown up in our communities and are aspiring citizens."

The bill had passed unanimously in the Florida Senate and with only four no votes in the Florida House -- two in committee by Reps. Jimmy Patronis, R-Panama City, and Jimmie Smith, R-Lecanto, who voted for it during final passage; it drew two no votes during final pasage from Reps. Matt Gaetz, R-Shalimar and John Tobia, R-Melbourne. 

But anti-immigration activists and opponents of the federal Real ID law, objected and, in a move seen as an appeal to the conservative right, the governor vetoed the bill. 

The only vocal opposition came at a April 4 meeting of the House Appropriations Subcommittee on Tourism and Economic Development when Paul Henry of the Florida Tea Party Network said the bill was an affront to law-abiding Floridians.

"I’m mad as hell,'' he told the committee, explaining that he was angered that his badge as a retired law enforcment officer was not enough to qualify him to get a Florida drivers license. "I’m mad as hell about how Florida citizens are being treated. This bill gives illegal aliens drivers licenses point and center. Homeland security does not pass laws, they write rules."

Bill sponsor, Rep. Randolph Bracy, D-Orlando, countered that all the bill did was allow these people to use their deferred action document as proof of residency. “These folks will not get anything that a regular citizen of Florida would get,'' he told the committee. "This would not present an unfair situation to the citizens of Florida.” 

The committee then approved the bill unanimously. 

Scott's veto is consistent with his hard line stance against illegal immigration in his 2010 campaign for governor, when he embraced Arizona's immigration law. But when the Florida Senate shut down an immigration reform bill in his first year if office, the governor has backed off the issue to the vocal disappointment of his Tea Party supporters.

Now, the Republican Party of Florida is working aggressively to improve its relations with the state's fast-growing Hispanic population, allocating millions of dollars for voter outreach and candidate recruitment. The veto was greeted with disappointment from some of the governor's followers.

"Jeeze, Rick. Was this necessary?'' tweeted Republican political consultant Ana Navarro.

The Florida House signaled the governor's veto when it modified its routine staff analysis of the bill on May 14 and added the phrase: "subject to the governor's veto powers, the bill has en effective date of July 1."

In the end, the decision by the governor may be but a symbolic victory. Children of illegal immigrants who qualify for deferred action will still be able to obtain a temporary drivers licenses under federal and state law if they have employment authorization from the federal government. 

"The ACLU of Florida sent a letter to the Department of Motor Vehicles today explaining that Tuesday’s veto should have no impact on that policy,'' said Simon of ACLU.

Corrections:
1) Paul Henry is with the Liberty First Network and Floridians Against REAL ID, not the Tea Party Network.

2) The identification card (not the badge) given me by the Dept. of Highway Safety & Motor Vehicles upon retirement was made on the same equipment that made driver licenses (prior to REAL ID), but it is insufficient to prove my identification according to the federal law.

Everyone except the citizens of Florida received relief for driver licenses from the legislature in 2013.

The very first bill signed into law this session by Gov. Scott gave relief to tourists driving in Florida- they are no longer required to have an international license.

While I am not a supporter of Gov. Scott, the governor's decision was the correct one for the reason noted. If the DHS ruled that bank robbers under age 30 would not be arrested and could keep the money, would this be any more legal than deferred action letters that defer prosecution for immigration violations? In Article 1 Section 8 of the Constitution, only Congress (neither the DHS nor the president) has the power to pass laws/rules/orders dealing with the naturalization of citizens.

I am interested to see if all of the legislators that pushed this bill through will lift one finger to give relief to Florida's citizens, such as married/divorced/widowed women that face a huge financial burden to re-prove their identity. I've offered a bill to do just that for the past two years, and it has fallen on mostly deaf ears. I put an amendment for driver license relief in the hands of Rep. Bracy after one hearing and he did nothing with it. Sen. Soto didn't like my tone when I wanted to discuss this issue with him.

We must give relief to the 15 million+ citizen drivers in Florida before we attempt to do so for illegal aliens. If our legislators, Democrat and Republican alike, will not do so, then they must be voted out of office.

Apparently he has not had to renew his Florida license since January 2010 when Republican REAL ID went into effect. If one reads Florida Statute 322.08, the document load is very clearly biased AGAINST citizens and had this law passed, FOR anyone holding a deferred action letter. Citizens attempting to renew their Florida licenses must produce one of the following:
1. A REAL ID compliant license or ID card from another jurisdiction (they CANNOT use their old Florida license, a military ID card, or a police ID card);
2. A certified copy of a US birth certificate (costs $$$);
3. A valid unexpired US passport (costs $$$);
4. A naturalization certificate issued by DHS;
5. A consular report of birth abroad;

This part alone has cost some women in Florida hundreds of dollars, on top of the more than doubling of the cost of a license from 2008-2009 ($20 to $48 thanks to REAL ID- which has cost the taxpayers millions and not prevented one terror plot).

Immigrants must produce one of the following:
1. A valid unexpired "green card";
2. A DHS employment authorization card; or
3. A number of non-immigrant classification documents issued by the DHS. The deferred action letters would have gone here, so they would be all that is needed to prove ID, see HB 235 lines 81-83.

After that, all that is needed is two proofs of residential address.

The main problem here is the DHS dictating how Florida is to issue their licenses, which is a clear violation of the 10th Amendment. About half of the states opposed and nullified this unconstitutional federal law- with the ACLU's blessing and help in places like New Jersey. When I asked the ACLU for help to do so here on several occasions, I was told they lacked the resources.

States must decide how to issue their STATE driver licenses, not the national ID card as supported by people like Mitt Romney and Marco Rubio, who buried an "enhanced" REAL ID requirement in his & Sen. Schumer's terrible immigration bill (S 744).

This Senate (477) Immigration bill must not be enacted on, as it plainly is no real difference than the one dropped on the American people 27 years ago? There is no certainty in the bill that anything new will happen at the border, to strengthen enforcement. The old war horses that held sway on the Mark-up last month rejected a revision of the 2006 Secure Fence Act, which would have given the American people a measure of security. 700 miles of double-layer fencing adorned with concertina razor wire, with all weather tracks in between. Then why even bother with the fencing if business owner who are not held liable for hiring unauthorized workers, with any degree of harsh prosecution? Can anybody tell me how many CEO in corporations, in large or small businesses went to prison? It’s just Mickey Mouse justice, especially if the Senate vote reaches the House of Representatives. Thousands of American citizens/lawful residents are threatened with being laid off, so that illegal aliens who receive a temporary work permit will be able to replace them as cheaper labor. Thousands of good, hard working contractors lost their businesses, because when so-called Guest Workers received green cards, they packed up their families and reappeared in the job market, in towns and cities across the country where innocuous contractors hired these people in every type of construction job, services and entertainment. The contractors and businesses that employed regular Americans couldn’t outbid or win contracts of those using cheaper job seekers. The farms and agricultural companies found themselves with a shortage of workers and began hiring the floods of migrants who illegal crossed the borders and the whole unlawful invasion started again. Those who managed to gain unlawful admittance brought their progeny with them, and later were able to sponsor immediate family members. WE, the gullible taxpayer are still having money extorted from our taxes, to pay for those in the first amnesty as we will again. NOTHING CHANGED THEN AND IT IS ESSENTIALLY THE SAME RAMIFICATIONS AS BEFORE. The vicious cycle is revolving again with more layers of Dream Act children, the misinterpreted law of instant citizenship for children of foreign born parents, the swelling of Sanctuary Cities and towns and the sponsorship of older parents and siblings that will become public charges and the taxpayers lament.

HOW CAN WE AFFORD TO PANDER TO MILLIONS OF ILLEGAL ALIENS ALREADY HERE, PLUS THE SUDDEN RISE OF UNFORTUNATES AWARE OF THE AMNESTY BEING DRIVEN BY BOTH THE DEMOCRATS AND REPUBLICANS, WHEN WE CANNOT MEET THE EXPANSE OF OUR PEOPLE? MANY OF OUR MILITARY STILL WAIT FOR BENEFITS, WHILE ILLEGAL ALIENS CAN APPLY FOR FOOD STAMPS. Our old folks are beginning to suffer, because of cutbacks in Medicare and other entitlements they fought for in previous wars and work for all their lives. Something is seriously amiss when I see service veterans walking the streets of Indianapolis, with nothing more than a few belongings. And yet politicians are ready to press for another similar amnesty, which was one big fraudulent program. To be truthful they have been influenced entirely by special interests; the lobbyists who use their corporate donors, to spread money around, flying politician and families on quasi conferences to spots across the world. With similar activities now exposed from the IRS, who spent taxpayers money on lavish away from home fun conferences.

It is time to abolish the IRS who has been caught red-handed working exclusively for the left in intimidating the Conservative agenda. I heard today that just one section of the mammoth agency, which acts on Americans as if we live in a police state. We should rid of them and replace the archaic system with a value added tax (VAT) a flat tax that specifically severs the corporate welfare and removes favoritism that instills a tax system that everybody pays. Even the “Deadbeats” that pay nothing would not be exempt, who sit on their loins watching TV or playing games on a computer all day.

I guarantee that if this immigration reform law gains acceptance, many politicians who voted for it, will fall beneath the wheels of the train. What with a free ride likely for illegal aliens as authored in mandatory ObamaCare health law and now more taxes will be incurred for millions of more illegal people who come in the future.

All the previous generations of Americans/ legal residents must band together on this urgent matter nothing will change. The wealthy purveyors of cash and favors in the pockets of the G8 will prevail, and the rest of us will be startled by the corrupt IRS institution wanting more taxes. As for the IRS after this fiasco, the whole institution should be abolished and let us enter the realm of a flat tax. A simple consumption tax on goods or a single, small rate of tax on income to fund each administration and the services provided. That is where taxable income and corporate profits don’t escape payment for living in this great country. A fair and equal tax that everybody will pay, without any exemptions, including, mega corporations who hide their ill-gotten gains overseas and even the poor must pay a small amount, instead of living of the taxpayer. IN CONCLUSION WE SHOULD DEMAND FROM CONGRESS A NATIONAL BIOMETRIC ID CARD, GIVING CITIZENS SOME MEASURE OF SECURITY IN CLAIMING A JOB, BEING ABLE TO VOTE AND AS A SAFEGUARD AGAINST CREDIT CARD FRAUD. If every citizen possessed a federal ID card there would be no more severe issues over identification in voting with non-citizen.
