Shalala releases statement on NOA

STATEMENT FROM UNIVERSITY OF MIAMI PRESIDENT DONNA E. SHALALA ON NCAA NOTICE OF ALLEGATIONS

“The University of Miami deeply regrets and takes full responsibility for those NCAA violations that are based on fact and are corroborated by multiple individuals and/or documentation.  We have already self-imposed a bowl ban for an unprecedented two-year period, forfeited the opportunity to participate in an ACC championship game, and withheld student-athletes from competition.

"Over the two and a half years since the University of Miami first contacted the NCAA enforcement staff about allegations of rules violations, the NCAA interviewed dozens of witnesses, including current and former Miami employees and student-athletes, and received thousands of requested documents and emails from the University.  Yet despite our efforts to aid the investigation, the NCAA acknowledged on February 18, 2013 that it violated its own policies and procedures in an attempt to validate the allegations made by a convicted felon.  Many of the allegations included in the Notice of Allegations remain unsubstantiated. 

"Now that the Notice of Allegations has been issued, let me provide some context to the investigation itself:

> Many of the charges brought forth are based on the word of a man who made a fortune by lying. The NCAA enforcement staff acknowledged to the University that if Nevin Shapiro, a convicted con man, said something more than once, it considered the allegation “corroborated”—an argument which is both ludicrous and counter to legal practice.

> Most of the sensationalized media accounts of Shapiro’s claims are found nowhere in the Notice of Allegations.  Despite their efforts over two and a half years, the NCAA enforcement staff could not find evidence of prostitution, expensive cars for players, expensive dinners paid for by boosters, player bounty payments, rampant alcohol and drug use, or the alleged hundreds of thousands of dollars in cash and gifts given to student-athletes, as reported in the media.  The fabricated story played well—the facts did not. 

> The NCAA enforcement staff failed, even after repeated requests, to interview many essential witnesses of great integrity who could have provided first-hand testimony, including, unbelievably, Paul Dee, who has since passed away, but who served as Miami Athletic Director during many of the years that violations were alleged to have occurred.  How could a supposedly thorough and fair investigation not even include the Director of Athletics? 

> Finally, we believe the NCAA was responsible for damaging leaks of unsubstantiated allegations over the course of the investigation.   

Let me be clear again: for any rule violation—substantiated and proven with facts—that the University, its employees, or student-athletes committed, we have been and should be held accountable.  We have worked hard to improve our compliance oversight, and we have already self-imposed harsh sanctions.   

We deeply regret any violations, but we have suffered enough. 

The University and counsel will work diligently to prepare our official response to the Notice of Allegations and submit it to the Committee on Infractions within the required 90-day time period. 

We trust that the Committee on Infractions will provide the fairness and integrity missing during the investigative process.”

EVERY JUDGE in EVERY COURT in the USA would throw this case out if it goes that far...how can the NCAA impose sanctions on UM when their INVESTIGATION WAS TAINTED?

Answer: It's impossible.

How can the NCAA throw out 20% of the information that they received unlawfully...how do we know that 80% should not be thrown out? After all, they TAINTED THEIR OWN INVESTIGATION = Not our problem!

UM is going to take the NCAA to court IF they think that the sanctions and even if UM thinks that the allegations are unfounded - and rightfully so BECAUSE OF THE FACT that the entire investigation was tainted.

I always say about bad people "give them enough rope and eventually they will hang themselves" - well, the NCAA has proven over the years to thinking that they are above the law, and they have used excessive power on various schools...however, with UM, they have HUNG THEMSELVES OUT TO DRY, because no judge in any court is going to be able to decifer what part of this investigation is valid due to the CROOKED THINGS that the National COMMUNIST Athletic Assoc. did to TRY to "get Miami" - therefore, any judge would HAVE TO THROW THIS CASE OUT.

I'm NOW a fan of Donna Shalala....because she's FINALLY SAID "enough is enough" - good for her.

@colacane -- fair enough, the Canes passed on the 2012 ACCCG and a bowl. The reality was, they were going to get slaughtered by an FSU team that was peaking at the end of the season as opposed to a beat-up Canes team. Sorry, you weren't going to the OB no matter how much you think otherwise. The fact they waited until the end of November to sanction themselves shows how measured and calculated their contrition on this matter really is. Wouldn't it have been more impactful to throw in the towel for 2012 back in November of 2011? Also, what about B-ball? No self sanctioning there.

A reasonable person will take note that the NCAA investigators were inept, however, they won't overlook the non-sense that went on at UM for almost a decade either. They are mutually exclusive issues.

I'd be sucking up to the NCAA big time if I was UM and not kicking them in the proverbial shin.

If you had the ability to understand what you read you would know that Ms. Shalala's response letter did not claim that the University of Miami is not guilty in all instances, thus the self imposing of sanctions.

Having not understood Ms. Shalala's letter you then pivot to Coach Al Golden, by far the best young coach in all of college football, and idiotically try too blame him for the NCAA problems.

As for Al Golden building a so-called pipeline to Arkansas...it is clear that once you start blathering your ignorant hate whatever pops into your demented mind you throw-up on these pages...get professional help hombre as all of us who read your nonsense can see that you are becoming nuttier and even more out of touch with reality as each day passes.

I felt all along that the NCAA would try to punish UM to the maximum level. In spite of the NCAA's corruption, they are still trying to accomplish this to justify their investigation and their very existence as the legitimate hammer of enforcement.

Miami is universally hated because of our swag teams from the past. That lingers with the NCAA. Remember the "Miami Rule" regarding excessive celebration?

Fact is the NCAA, the hack lawyer Perez and the psychopahic twerp Shapiro have colluded to harm Hurricane athletics.

The NCAA stating that they would accept Shapiro's testimony AS FACT if certain UM witnesses would not testify is fascistic at its base.

I hope UM has recourse to smack these dirtbags down, as so many in sports media are now doing.

I'm sure you remember the days when the dolphins use to play the same defense clownn 117th is trying to run here when the Dolphins had lankford and judson out their playing 10 & 15 yards off the line of scrimmage, just allowing teams to drive up and down the field. All shula did was draft a bunch of big 10 players and ran that type of defense, here we were in 2012 running that same bozo defense with who, the same conservative big 10 minded type who don't understand what aggressive and in your face type of defense is.

In fact what alot of people don't realize, golide and his boy are setting our defense back 20 years. That defense is run for teams that don't have the athletes to play man. It's a cowards scheme. When you got guys like deon bush and tracy howard back their, you don't play a cowards scheme on defense, that's for sure.

gallo, when i read that "he's good in the weight room" crap, all i can say to myself is, where did that come from. And that's his whole problem, he keeps thinking guys will become that much better by getting stronger, if that's all it took to play football and win games was to get into a weight lifting contest against the other teams than why didn't we think of this in the first place. Your post was excellent, although I strongly disagree with your comment found above.

If not for the self-imposed sanctions the NCAA would argue for the death penalty and could have won. This show of contrition is already paying dividends based on several commitments I have read from current and former NCAA infractions members. It has also played a role in turning the media to our side...a stunning development!

Additionally, not self-imposing sanctions would have played directly into the grimy hands of Mark Emmert. There is no doubt that Miami will be handed down sever sanctions by the infractions committee. Emmert purposely dragged the investigation out knowing this black cloud over our programs was very destructive. Going forward, had we then been forced to serve 2 to 3 bowl bans and 25 or so scholarship reductions spread out over a number of years would have been catastrophic and served to be the death penalty the Emmert so desperately wants leaving us in the position SMU was after their run in with the NCAA.

Finally, the self-imposing was an astute move and one that without a doubt has the chance of significantly reducing the damage to our football program.

I hope Golden use this NCAA story to its advantage, he should paste it on every locker, every, wall, every tackling dummy and stress to the players how they have been treated and spit on for the last two years. He needs to stress how other schools used this story to go behind our backs like cowards and trash our name during the recruiting season. The NCAA just woke up a category five hurricane and ever city and very state that's on it's schedule is in its path. Time for an undefeated season.

It's not gone matter what goldie paste on wall lockers, if we're going to continue to play this prevent defensive scheme, none of that is going to matter. Although i get what you're saying, offensively we might be able to punish teams, but defensively, we'll more than likely continue to allow teams to score almost at will.

Especially if we need a defensive stand, how many leads have we given up and lost games since clown 117th has been in charge. He's cost goldie almost every lost, keep on keeping on with em coach goldie.

While i do think goldie would land somewhere else as a headcoach if he got fired here, i highly doubt it'll be with a top notch program, that's for sure and definitely nowhere in the sec. He'll show up with that big binder he keeps calling his "life's work" and present himself well at somebody's interview, but if they cut on the tapes and ask him, you come off and present yourself outstandingly, and you have a very detailed road map, but how is that this plan didn't work at Miami, the epitome of college football.

Randy Shannon had his chance at UM Head coach. What happen? Sorry Calvin but you need to do your research! While contracts are usually written with that clause to protect the University. That wasn't the case with Randy Shannon. His contract said that if he was fired without cause that the UM had to buy out his contract regardless if he was employed or not. The buy out for the remaining money owed was $1.5 million paid out in 4 payments. Shannon sued Miami because they prorated his payments at 5/6th's (since he was let go 10 months into the calendar year) and they didn't pay him the bonus money for the team going to the Sun Bowl since the Canes were bowl eligible at the time of his firing. Don't act like Gallo and try to push your speculations off as fact.

Gallo, Butch Davis is NOT the answer because North Carolina fired him after their football team ran into trouble with the NCAA under his watch. Is that really what Miami needs at this point? If they hire Butch Davis then the NCAA might as well as set up a permanent office on campus. Stop being a dumb arse and look at the BIG picture. As for those scholarships. They had 3 allocated for Matthew Thomas, Jay-Nard Bostwick, and Keith Bryant. Those guys just filled their scholarships. As for him saying that they probably only have room for one more, remember that the NCAA notified UM about the investigators mess up before they went public with it. Miami could have very well had changed their tune thinking that the tables have turned against the NCAA.

The good news is that the NCAA is taking a beating on the PR front and Michael Felder of the Bleacher Report is saying that the Universities are starting to line up behind Miami against the NCAA. If true, this will put tremendous amount of pressure on Emmert as the schools are the life line of the NCAA.

Can the NCAA pick and choose whom they want to judge Miami from infraction team whom are pro Emmert, this guy now has to step down he is making a case for extrmeme precitgous against Donna and Miami. He does understand if he prejurys himself its jail time in Florida, oh my. The NCAA needs to stop the whole mess and put Mark to bed and try to gain respect back that has been lost by Emmert, he would make a good keystone cop.
