Hurricanes DL Dyron Dye lawyer to NCAA: Hurry up! Dye getting physical Monday, wants eligibility ruling

      The NCAA is taking its time in more than one way.

      University of Miami defensive lineman Dyron Dye, the lone current Hurricanes player still connected to Miami’s NCAA investigation, wants a ruling or clarification -- anything but silence --  from the NCAA on his eligibility.

    Dye, who has been recuperating from an Achilles injury since March, told his attorney, Darren Heitner of Wolfe Law Miami, that he is going to be examined by a doctor on Monday to determine if he is ready to begin training with the team.

    But first he needs the NCAA to let him know if he is eligible to participate this season, which would be his last in college football.

     The NCAA interviewed Dye three times because it believed an affidavit signed by Dye that supports ex-UM receivers coach Aubrey Hill -- now the head coach at Miami Carol City High -- contradicted statements made in at least one of Dye's former interviews.

     Now Dye and Heitner are "waiting for clarity and guidance from the NCAA" as to whether he will be hit with an unethical conduct charge. But Heitner said they haven't heard anything since the third interview.

    UM hasn't had to make any rulings on Dye's playing status because he has been injured since March. But now it appears he could be cleared medically. The usual procedure is that the school is the first entity to suspend a player, then leaves it up to the NCAA, as it did with the previous players involved in the case, to decide on the player's eligibility.

   UM coach Al Golden on Aug. 10 wouldn’t elaborate on Dye’s status, other than to say, “He’s on the injured reserve for us’’ and to add that “he’s still rehabbing’’ and “doesn’t count against the 105’’ on the roster.

   Dye has not been on the practice field during fall camp. 

    "Dyron is one of the strongest, most focused players I have ever seen,’’ Heitner said Friday morning in an email to the Miami Herald. “Many questioned Dyron's ability to be physically able to participate for the Miami Hurricanes in 2013 after he suffered an achilles injury during the team's first spring scrimmage in March.

    “I spoke with Dyron yesterday and he told me that he believes he is fully healed and will be going in for a physical examination on Monday with the expectation that he will be cleared to play effective immediately.  My only concern is that Dyron is given the opportunity to participate on the University of Miami football team when he is medically cleared.  The NCAA needs to make a determination regarding his eligibility to participate in the upcoming season.  Any further delay on the NCAA's part will cause irreparable damage to my client."

    In June, Dye filed an incident report to the Coral Gables Police Department in which he alleged being “coerced’’ by former NCAA investigator Rich Johanningmeier to provide answers that would aid the NCAA’s attempts to confirm incriminating information in its investigation of the UM athletic department and rogue booster Nevin Shapiro.

   Nothing ever resulted from the report.

    Dye, who would begin his fifth-year senior season, was interviewed by the NCAA twice on the same day in August 2011. In the incident report, Heitner said that “prior to the start of the second interview, Mr. Johanningmeier coerced Mr. Dye into providing favorable answers for his investigation.’’

    The NCAA could decide to accuse Dye of an unethical conduct violation, which could result in him being ruled ineligible. Dye was already was suspended for four games in 2011 and had to repay $738 in benefits given to him by Shapiro during the recruiting process.

   Miami still hasn’t received its NCAA sanctions in the case, though the penalties could come any day. On Friday morning, UM athletic director Blake James said on WQAM 560 radio that he had “no idea’’ of what was to come.

The NCAA needs to lay down all their rules for everyone in COllege Sports to see.

Being selective (as they have been,) has created a muddled implementation of what Colleges "THINK" the application of actions viewed by the NCAA should be.

Coach Golden is on the right track.
Layout the rules and appoint a representative to confer and oversee said ruled at each College location.
No need to misinterpret anything, and this would engage accountability at the NCAA level.

That seems to be too logical and easy to work for the NCAA.

NCAA President, Mark Emmert wasn't two paragraphs into the Yahoo! story before he jumped up and called for a national press conference where he bellowed, "the death penalty is on the table concerning Miami".

Conversely, when the Penn State story broke he waited almost a week before commenting. And after being badgered for a statement he said that the Penn State matter was a law enforcement issue, not something the NCAA would be involved in.

Well, there was such an outcry over Emmert's stunning Penn State position he was forced to reverse field and say that the NCAA would look into the allegations after all.

The point being is the NCAA under the leadership of Emmert has a good ole boy list and a list that Miami is on. Emmert believes he will be a hero to many across the country if he destroys the Miami football program, which there is a lot of truth too.

Emmert laughably said, "Now that the Miami investigation is before the infractions committee he no longer has any input in the matter". Really? Seriously? Does any rational person with a grain of knowledge as to how Emmert and his NCAA attack dogs have treated Miami believe that absurd comment? Of course not!

If not for Al Golden Miami's football program would be dead. And that fact frustrates the living hell out of Emmert who firmly believed that by dragging the investigation out as long as he has would be just as damaging as handing down the death penalty to Miami.

While I hope I am wrong--I suspect this persecution by Emmert and his NCAA will end up being litigated in the U.S. court system. Of course this will do even greater damage to Miami as this witch hunt hangs over the programs head, but at least Emmert will be proven to be a professional liar intent on using any means to end the Miami football program. It will also lead to the firing of Emmert, which will be good for college football.

If Dah U takes the year off or not it doesn't matter since they won't amount to much if they do play. They won't be ranked high, if at all, they won't be in contention for a NC or even the sorry ACC ship, they will be totally irrelevant. Just like in the past 10 years.
And the idiot who claims UM doesn't need any of the Gator's recruits is just an idiot. You need as many good players as you can get, you don't, that is why you have no depth and kep having to throw the freshmen into the fire. Thus you will remain mediocre for many more years to come. Fools.

1 Dalvin Cook - Good running back, but knew he could not replace Duke or even beat out his own teammate in Yearby, who already committed to the Canes, so he chose to go to a school DESPERATE for RBs.
2 Ermon Lane - One of 16 offers, but knew we were stacked at WR, chose to go to a school DESPERATE for WRs.
3 Quincy Wilson - not even offered by the Canes, despite being local.
4 Chris Lammons - Chose one of 18 schools that offered to him based on where he could start right away.
5 JC Jackson - Immokolee is not part of the tricounty area, so it is not part of Miami's recruiting core.
6 Khairi Clark - Solid player, Florida one of 30 schools that offered to him, but his academics were such that he went for the easy to handle school.
7 Duke Sawson - not even offered by the Canes, despite being supposedly local. Neither was Gator verbal Duke Dawson. Guy is from Dixie county, right next to Gainesville, so why should he be on this list? And we already have a BETTER Duke on the Canes.

So, in your RANT claiming we were smoked based on seven guys, it was with two guys not even in South Florida, two guys we didn't offer, one guy who we already have his better teammate, one guy that would have been a backup in our deep WR corps, and a couple guys that were eager to leave South Florida to avoid the competition already on the Canes.

Meanwhile we have these 14 players that the Gators did NOT get, so much for being SMOKED.

Dear all,

I don't like the idea of facebook. I've posted here for years and try to contribute to the more intelligent commentary of this blog.

I don't like the lower-level exchanges and essential cyber terrorism, but I really don't like anyone stepping on freedom of speech. This is a newspaper! You all are supposed to defend freedom of speech! Let other private blogs ramp up the security. I'm not excited about needing facebook, which I find to be a potential conflict of interest, in order to participate in this forum.

This is sad. You all in charge need to find a better way to police the blog or let the blog police itself. Why don't people just not respond to the trolls? Furthermore, i'm not sure what you all will do with violators or how you'll determine what constitutes violation of blog conduct.

This is very strange. You all need to find a better way. A quarter of the blog is not enough to sustain meaningful discourse and neither does it constitute a majority. This should not cater to any one demographic and I think the leadership/administrators of this blog would do well to leave this issue alone. Let us police ourselves.

Mark. This is the best "team" in a decade. Stephen and Duke are the best 1-2 punch since Ken Dorsey and Willis/Frank. The O line, though banged up is deep. The D line and corners are probably the biggest question marks without proven playmakers, but they bring more experience than in recent years. Big things ahead for ACC champs.

You people are an embarrassment and would be mortified if people you know in real life knew how much time you spent trolling each other.

So yes, Facebook login would immediately fix the problem and make the blog functional for UM fans who aren't ashamed of their opinions or posts.

From time-to-time I post comments on this web site. My comments are rational and balanced, do not have expletives, etc.. To require membership on facebook is out of the question for me and I don't have any intention of joing so I can post here. So ends my interest iwith this site. How very sad it is you are chasing away interested readers.
