Judge extends stay in resign-to-run case

A Miami-Dade Circuit Court judge last week disqualified Doral Councilwoman Sandra Ruiz to run for Florida House District 112 -- though his order would not go into effect for seven days.

Now that stay has been extended by the Third District Court of Appeal, which is giving Ruiz's case expedited consideration. Ruiz's lawyers must file their appeal briefs by Wednesday. Attorneys for Republican Jeanette Nuñez and Democrat Johnny G. Farias must respond by Monday, with Ruiz's follow-up response due next Tuesday.

Nuñez and Farias sued Ruiz separately -- though they have been consolidated on appeal -- saying she should have submitted a letter resigning her city council seat effective Election Day. Ruiz has argued she does not have to because her Doral term expires and would not overlap with a potential term on the Legislature.

Ruiz, Nuñez, Farias and three orders are vying to replace Republican state Rep. David Rivera in a district that spans Collier, Broward and Miami-Dade counties.
